1. Agreement

These Terms govern your use of Emthree (the "Service"), operated by DBR Ltd. ("we", "us"). By using the Service you agree to these Terms. If you don't agree, please don't use it.

2. What Emthree does

Emthree is a browser-based tool that scans music files on your own device, lets you build playlists, and exports them as M3U/M3U8 files. The audio files are read locally and are not uploaded to us.

3. Accounts

You can use core features without an account. Some features (collectively "Pro") require a free account:

  • You're responsible for keeping your login secure and for activity under your account.
  • Provide accurate information when registering.
  • We may suspend or terminate accounts that breach these Terms.

4. Free and Pro tiers

  • The Free tier includes unlimited scanning, playlist building, full-length M3U export, and saving up to 3 playlists locally.
  • Pro adds cross-device sync and backup, unlimited saved playlists, and smart playlists. Pro is intended to be offered at £15 per year.

We may change what's included in each tier; we'll give reasonable notice of material reductions affecting paying users.

5. Billing and subscriptions

Paid Pro subscriptions are not yet available. When they launch, the billing, automatic-renewal, cancellation and refund terms will be published in this section, and your statutory consumer rights will continue to apply. Until then, Pro features are accessible with a free account.

6. Your files and your content

  • You keep all rights to your music files and the playlists you create. We claim no ownership over them.
  • You're responsible for ensuring you have the right to use the music files you scan, and that your use of the Service complies with applicable law.
  • You agree not to use Emthree for any unlawful purpose, or to infringe anyone's rights.

7. Our intellectual property

The Emthree software, branding and design are owned by us and protected by law. These Terms don't grant you any right to copy, resell or reverse-engineer the Service except as permitted by law.

8. Third-party players and services

Emthree exports files for use with third-party software and devices (such as VLC, Plex, Jellyfin, Rockbox and DAPs). We're not affiliated with them and aren't responsible for their behaviour. Any album art or metadata sourced from third-party databases is provided by those sources "as is."

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. We don't warrant that the Service will be uninterrupted, error-free, or that exported playlists will work with every player or device.

You are responsible for your own files. Emthree reads your music to build playlists; you should keep your own backups. We're not responsible for any loss or corruption of your files or data.

10. Limitation of liability

To the fullest extent permitted by law, we won't be liable for indirect, incidental or consequential damages, or for loss of data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim. Nothing in these Terms limits liability that cannot lawfully be limited (such as for death or personal injury caused by negligence, or fraud).

11. Termination

You may stop using the Service at any time. We may suspend or end your access if you breach these Terms. On termination of a Pro account, your synced data is handled as described in the Privacy Policy.

12. Changes

We may update the Service and these Terms. We'll revise the "last updated" date and, for material changes affecting paying users, give reasonable notice.

13. Governing law

These Terms are governed by the laws of England and Wales, and disputes are subject to the courts of that jurisdiction. Mandatory consumer-protection rights in your country of residence still apply.
